INFORMATION ON PROTECTION OF PERSONAL DATA

Dear customers, we would like to inform you about the provisions of Law on the Protection of Personal Data, No. 6698 (“KVKK”).

Any information that makes you identified or identifiable will be processed as Personal Data by our company (Garanti Finansal Kiralama A.Ş.) in the capacity of Data Controller within the following scope. “Processing of Personal Data” means any operation which is performed on personal data such as collection, recording, storage, preservation, alteration, adaptation, disclosure, transfer, retrieval, making available for collection, categorization or blocking its use.

For what purposes are your personal data processed under the services you get from the Company?

- To use in all kinds of products and services that we can offer for you under the Financial Leasing, Factoring and Financing Companies Law No. 6361 and any other legislation,
- To record identity, address and other necessary details for designating information of a person who performs the transaction or has it performed,
- To keep and maintain records and documents for the periods prescribed in the laws, - To ensure transaction security,
- To fulfill any data storage, reporting and informing obligations prescribed under law, other legislation, BRSA, CBRT and by other authorities,
- To offer demanded or company’s products or services and fulfill the requirements of your contract.

For what purposes and to which persons or organizations can your personal data be transferred under the services you receive from the Company?

Your personal data may be transferred to public and private entities that are clearly authorized by the law, including but not limited to those listed below, for the foregoing purposes to the extent permitted by the Financial Leasing, Factoring and Financing Companies Law No. 6361 and any other legislation.

- Financial institutions and other third parties listed in Article 73/4 of the Banking Law no. 5411,
- Public and/or private entities such as BRSA, CMB and CBRT
- Our principal shareholder and direct or indirect local/foreign affiliates,
- Program partners, local/foreign banks and other third parties from whom we buy services and with whom we cooperate for conduct of our business for the foregoing purposes.

What are the methods and legal reasons for the collection of your personal data?

Your personal data may be collected verbally, in writing or in digital format by Head Office, Branch Offices all digital channels such as call center pursuant to the Financial Leasing, Factoring and Financing Companies Law No. 6361 and any other legislation applicable to our company.

Your rights pursuant to Article 11 of KVVK*:

You have the right to apply to our company and (*):

a) to learn whether your personal data are processed or not,
b) if processed, to request information in connection therewith,
c) to learn the purpose of processing and whether such data are used for the intended purposes or not,
ç) to learn the identity of third parties to whom such data is transferred at home or abroad,
d) if your data are under-processed or misprocessed, to request correction of them,
e) to request deletion/destruction of your data under the conditions set forth in Article 7 of KVKK,
f) to request notification of transactions performed pursuant to clauses (e) and (f) above to third parties to whom the data are transferred,
g) to object against a result obtained in your disfavor due to analysis of such data solely via automatic systems,
ğ) if you incur damages due to processing of your data in violation of the laws, to demand indemnification of your loss.

(*): The provision pertaining to your rights under Article 11 of the Law shall enter info force after 6 months as of the publication date of the Law.
